Terms and Conditions

1. Services and Scope

Wild West Water Delivery (“the Company”) provides potable water delivery, equipment rentals, and dust control services. By booking a service or renting equipment, the Client agrees to be bound by these terms. All water provided is Maricopa County certified as potable at the time of delivery.

2. Delivery and Access

  • Site Preparation: The Client is responsible for ensuring a clear, safe, and accessible path for heavy-duty water trucks and trailers.

  • Liability for Access: The Company is not liable for damage to unpaved roads, driveways, sidewalks, or underground utilities (e.g., septic lines, pipes) resulting from the weight of the delivery vehicles.

  • Gate/Entry: If a driver cannot access the site due to locked gates or obstructions at the scheduled time, a dry-run fee may apply.

3. Water Quality and Use

  • Post-Delivery Integrity: While we guarantee the purity of the water upon delivery, the Company is not responsible for contamination that occurs once the water enters the Client’s storage tanks, pools, or equipment.

  • Storage Maintenance: It is the Client’s responsibility to ensure their receiving vessels (cisterns, hot tubs, etc.) are clean and sanitized prior to delivery.

4. Equipment Rentals (Tanks & Trailers)

  • Rental Period: The rental begins the moment the equipment is dropped off and ends upon scheduled pickup.

  • Damage and Loss: The Client is responsible for any damage to the equipment while on their property, including theft, vandalism, or misuse.

  • Prohibited Modifications: Clients may not move, alter, or modify rental equipment without express written consent from the Company.

5. Cancellations and Weather

  • Cancellations: We require  24 hours notice for cancellations to avoid a service fee.

  • Arizona Weather: While we are engineered for the heat, the Company reserves the right to reschedule deliveries in the event of extreme weather conditions or “Acts of God” that compromise driver safety.

6. Payment and Fees

  • All services must be paid according to the terms outlined in the invoice.

  • Late payments may be subject to interest charges as permitted by Arizona law.

7. Limitation of Liability

The Company’s total liability for any claim arising out of the performance or non-performance of services shall not exceed the total amount paid by the Client for that specific service.
